      An update, GM meeting held 12th July and the OC had issues with the Strata Managing company. The Licensee in Charge chaired the meeting which was unusual. The OC acknowledged that NSW legislation had been broken (undisputed as I have a letter from NSW Fair Trading that says that) and the Strata Managing company admitted they broke the law, just by people that had since left the company. Upshot was the spoiler motion was raised and prejudiced my motions.

      The OC decided not to mutually depart with the Strata Managing company and look to get new Managers after agreement expiry in 7 months.

      in the meantime, we have handed a $2m remediation project (see my waterproofing entry) to a Strata Managing company that can’t even abide by NSW law. The kicker being today the SC held a paper vote to raise a by-law about our communication within the OC….

        The backdating request was in writing on no less than 2 occasions and the Strata Manager has supplied minutes to GMs outside of the required 14 days.

        I have reported this to the SCA NSW and they have opened a case.

        We have our next GM in 16 days and the Director of the Strata company has an agenda item to address the SCA NSW complaint with the OC. Do they have grounds to do so, when the complaint was made without requiring OC approval as the claim and supporting evidence is indicating serious or unprofessional conduct?

        A footnote on the NCAT matter, a Statement of Claim has been raised in the Courts and at the above mentioned GM the agenda item is to serve the Claim on the contractor. These actions meant our legal advice was to discontinue the NCAT matter as it could be successfully defended.

          I did join the committee for a year and nothing was achieved in that time. I did not reapply after the Strata Manager requested we back date our votes on motions. Regrettably, I am not going to participate in something that can be considered fraud. Thank you for the replies, I will continue to pursue a positive outcome for the OC and the building. Will let you know how the section 232 goes in NCAT.

            (In NSW) Our building suffers from a disgraceful Strata Company and Strata Manager. As a flavour, used an unlicensed trade, formed a quote of works (dated when trade was not registered with NSW FTrade)all the while when the trade licence was restricted under HBCF and couldn’t have carried out the quote at the time of the GM and did not bring any of this up to OC at the GM to consider the Works.

            Signed a contract for works after works had commenced, HBCF insurance filed 14 days after project commenced. Trade did not complete scope of works, no credit applied for work not done, the list goes on….waterproofing job carried out by company not licensed in waterproofing.

            As it is common property affected, our balcony what can we do?

            Can we as lot owners apply to have the Strata Company removed based on these issues?
