There’s a question this week that has echoes of a couple of stories about non-residents parking in strata buildings.
The first that springs to mind concerns the owners at Elizabeth Bay Gardens in Sydney who, in February 2018 lost a case at the Supreme Court where their by-law banning non-residents from parking their cars in spaces they had bought at considerable cost was declared invalid.
Six months later the Owners Corp also lost at the Court of Appeals, as this story by our own Sue Williams relates.
More recently, there was the young woman, a tenant, who bought electronic garage gate “beepers” and reprogrammed them, renting visitor parking spaces to workers on a nearby building site.
The builders, who had paid for weeks of illicit parking in advance, were furious when the owners corp discovered the scam and reprogrammed the gate mechanism, locking them all out.
The tenant fled the apartment block, leaving other unpaid bills behind and the builders wanted to sue the owners corporation to get their money back. Don’t think that would get too far.
