      OC approved a special by law by one vote. The next day the SM writes saying it was so close a recount was required? Correct or not?
      One of the OC held 5 proxies and he voted against the by law.100 lots

      6 proxies and 20 people in attendance ..,

      what are the next steps?

        There is no provision in the act for a recount.

        At the meeting, an owner can ask for a poll vote, which is a form of recount. But if it was not asked at the meeting, then it can’t be invoked after the meeting.

        In any case the vote declared at the meeting is the one that stands.

          thanks very much for your reply, kaindub. I have requested all “paperwork “ and the strata roll. It appears one owner (not on the SC) is controlling the communication resident system and acts as a sensor to stop some residents commenting! That same owner gathers proxies to ensure he keeps control . Hard  to believe this behaviour is tolerated but probably due to lack of interest throughout the scheme.

            It appears one owner (not on the SC) is controlling the communication resident system and acts as a censor to stop some residents commenting! That same owner gathers proxies to ensure he keeps control.

            The resident can only have one proxy for every 20 owners.  That’s another 19 owners per proxy from who you could surely garner someone to support you, if nothing else but to negate their controlling vote.

            The easiest way to get uninterested owners to take an interest is to tell them their money is being wasted.  Anything else is just garden fence squabbles to most people.

              yes that true, Jimmy. naively I didn’t think the by law was contentious. The GM only had a few items on it, and only one by law that was legally planning to change something that numerous other owners do in breech of  by laws. Owners are disinterested even when levies escalate! They simply avoid OC unless they want something personal.  What a minefield Strata is, bullies control and squash those who try and abide by the law! SM trying to dodge the responsibility of the vote, after declaration ! 😩
