      I’m Just wondering how does an OC work without a chairman

      I’m chairman of  a committee of three ,  12 units in all .

      The other two members are  a vexatious   person who writes nasty pages and pages of invective each week to me, the managers and tradespeople  and  I’m constantly having to appease them all.  The 3rd is his girlfriend  who wants to please him.   

      Despite this,  I’ve achieved a lot since being chairman for 1 year, but it’s been a real battle.   (.Btw they elected me as they didn’t want it). 

       

      Anyway  Ive had enough.  

       

      So if/when  i resign , though I’ll remain on the committee, and if no one else wants the position,  how does anything get done?   I would gladly appoint our managers who are excellent to take care of things but I don’t see it happening.

        I think in those circumstances, the position of chair defaults to the strata manager (if you have one).  They can also serve as secretary or treasurer until such times as an owner is elected to one of those offices.

          Miranda – Are the other two committee members valid members? Do both the boyfriend and the girlfriend own separate Lots in your building?

            Excellent point. Section 31 (4) and (5) of the Act clearly bans co-owners from being on the committee at the same time unless they own more than one unit.

            31   Persons who are eligible to be appointed or elected to strata committee

            (1)  The following persons are eligible for appointment or election to the strata committee of an owners corporation:

             

            (4)  Only one co-owner (including a company nominee of a co-owner) of the same lot may be a member of a strata committee at the same time, except as provided by subsection (5).

            (5)  A person who is an owner of more than one lot in the strata scheme may nominate one person for election as a member of the strata committee for each lot for which the person is an owner.

              Thanks for your responses, much appreciated,  yes the other 2 are valid members as they are separate Lot owners. 

               

              I have now resigned as the chair but remain on the committee and  already there are pressing things to be done around the place and they are just hanging in limbo , but others can  do the work now.  .

                Miranda – Are you able to encourage more owners who share your view to become committee members? This may require you contacting the other owners personally.

                All you require is another two owners, who believe in similar things that you do, to become committee members and then your shared and similar views become the majority view on the committee.

                  About 6 weeks ago I wrote to all the owners via our strata manager( who sent my letter to each one via email) .    I pointed out that fresh blood and ideas would be very welcome on the committee but kept it low key blaming no one.    I did say that some non-costly touches to the place like some paint here and there would improve their investment considerably.    The response was zero.

                  Pretty frustrating as the committee I was on in my previous strata unit worked well together and we got things done promptly and amicably.  Here, when I arrived not even important things like OH&S matters had been attended to for years… which I  attended to as well as so much else.I gather the then chair (whose flat I bought) pretty well folded  up with all the malice  from the vexatious committee member I mentioned in my op.

                  Without support from the owners I can’t do anything more and just hope it doesn’t all fall into the sinkhole it was when I arrived.
