Hi all

Just after more of an opinion I guess as what I'm proposing is not actually allowed…

I live in a duplex on a survey-strata lot (there's 4 'duplexes' in a row all facing the street, not villas), have a shared carport (although my side is my own, not common property) and shared driveway which is common property. My neighbours chain smoke and entertain in this carport, etc but I'm now installing carport divider and fences that fit within my local council's rules.

The divider won't completely block my view of them, nor their smoke as I can only install to a length of 5 metres, but I propose to put a raised garden bed (the colourbond above ground vege garden kind) on my side at the end of the divider. As this is common property I am not technically permitted to do this, but about 1.5 metres out from the end of their carport the neighbours have a scrap/junk car (ie hasn't run for 10 years, flat tyres, unregistered 'gunna do-er-up' project that never will happen) which is technically on common property.

Now if the neighbours were to complain about this innocuous little garden bed I'm assuming that I wouldn't have any problems considering that they have the scrap car on the equivalent part of 'their' side?

Also, I'm a little confused as to who enforces by-laws, etc if not local council?

PLEASE ... If your property is not in NSW, mention its location (state). Don't identify companies or individuals by name. Don't mention or promote your company or services. Keep acronyms and initials to a minimum. Please, don’t use “quote” unless there is a specific point to which you wish to refer, then highlight (define) that specific passage before you click on "quote". Otherwise just use reply. THANKS.
