I had this problem a couple of years ago living in a studio apartment, when an almost baby moved in above with his angry mother and began stomping and banging on the floor above my bed. I tried polite requests but this only made her crankier, and she began abusing me on common property.
Even tho the family that had rented the studio lived in the same building, they were no help. Nor was the Strata Manager. I did consider NCAT, but being an older person, in the end I retreated and had to move to save my sanity.

I’ve read the article in Flat Chat about the person in the UK and noise etc.

But even in NSW, there is noise over which we have no control, eg children, babies living close by.

I had been happily living in a studio apartment in the inner city for many years, until a woman moved in above me with a noisy 2-year-old and my life changed abruptly.

Nothing I could do through the Building Manager or Strata had any control over this. It eventually affected my health so badly that I had to move (at 77 years of age).

It was suggested that I go to the Tribunal but the stress involved and aggression of this neighbour made that difficult. And the reviews I read about NCAT averaged 1 star out of 5, so that didn’t fill me with hope.

Please don’t assume that all we have to do about noise is get it fixed through Strata or the Tribunal. It is possible to have uncontrollable noise in an apartment in NSW.

Yes, i’ve had the same problem for over a year. I live in 23m2 stud with no escape from a single room. The tenant above (same sized studio) has a noisy toddler who continually runs around squealing and thumps/jumps on the floor most of the day and into the night. We have two parks close by but they don’t use them. Strata Manager doesn’t want a ‘media outbreak’ so minimal action.

i’m 75 years old, a vulnerable person and had a hospital visit 6 weeks ago related to the continual stress. I’ve been told to go to Tribunal, but also warned that if a child’s involved it will favour the tenant. Also the reviews from others who used this method are negative.

What can we do?

Good luck trying to use the noise bylaw. I’ve had a noisy toddler above me for a year now and our Strata manager won’t pursue it further because it’s a child.

so the bylaws can be useless in some cases. But good luck anyhow.
