Forum: Landlady dives in before tenant has left

When does a residential lease end? According to the standard lease (in Victoria) it’s on the date when the lease expires, unless a different arrangement is agreed.

According to Tenants Victoria, it’s when you hand back the keys, although you may have to pay the rent up to the expiry date if you leave early and the property owner can’t  re-let the place.

Flatchatter Roaming Renter has kind of half left his old apartment for a new one nearby, handing over the keys 10 days early but leaving a few valuables behind for collection later.

Has he vacated the property?  The landlady clearly thinks so as she is wandering in and out of the unit at will, using the car space and even the pool and spa.

He thinks the flat and the facilities are still his, regardless of whose desk the keys are sitting on, because he has paid rent right up to the lease expiry date.  Who’s right?  And can he ask for a refund on his rent? That’s HERE.
