    Dear helsta,

    Great to hear you are a pet friendly building and I am sorry your moggy has decided to hang out upstairs but I do wonder how your kitty cat gets upstairs?

    I could be wrong but I believe your animal kept on lot should be kept in lot.

    I am unaware of any bylaw that stops residents from feeding neighbours pets. Do most by laws state the animal should be carried or on a leash when on Common Property? So kitty getting to your neighbours house may be crossing common property?

    I think the onus may be on you helsta. But I could be wrong depending on your registered bylaws. Kitty should probably not be wandering about Common Property or on another lot. Smile

        Hi All,

        I don't think a proxie is valid when the owner appointing the proxie is present at a meeting? So it should have I think been one or the other allowed to speak or vote at the meeting. Not sure actually why a proxie is appointed if the owner is available?

        Yep, council are good for this. Or… you can a have an Oc/health and Safety report done which will cost you but if you also point this issue out to the inspector it may be rectified. Or not! They may only look at your building and not interference from next door. Then again, it can work against you as the inspector often finds minor defects in your building that will cost you to repair and they give you a short period of time to rectify. Not good. Surprised

        This sounds like the bath is a freestanding tub on claws maybe? So the pipes would be in lot owners space? Otherwise I really dont understand how pipes under the bath which would normally be within CP ceiling/walls could be considered lot owner resposibility if Lot owner is only responsible for air space?

        Hi All,

        Just curious.

        So what if… the clothes dryer is installed and included in the Lot as there are no external drying lines and the dryer must remain in the Lot throughout sales and tenancies? Is it then considered a fixture? I guess even if it is a fixture repairs are still the responsibility of the Lot Owner?

        Hi Infocus,

        Although your complaint and concern regarding smoke fumes are totally valid I wonder if perhaps you have a bee in your bonnet regarding your neighbour?

        As JT and the others have supplied, there are avenues of complaint before you begin looking at legislation. You must really want to stick it to your neighbour.

        I live in a building where there are also commercial premises.

        Laundries, nail salons, hair salons, printers. These all give off offensive chemical smells and fumes that I am sure are not condusive to good health. Mobile phones are also proving to be a precurser to certain cancers.

        I have just come to the conclusion that the OTHER stuff out there is just as bad as ciggy smoke so I live and let live. One day there will be Non Smoking buildings available for non smokers to buy into.

        Moving away from the legalities…..

        For me as a pet owner and Committee Member in a pet friendly block we still have issues with dogs. They are generally noisy, smelly and their crap as in poop is pretty obvious especially when other lots look onto dog owning lots. What a nuisance! Cats are more discreet, unless of course they are allowed to wander.

        I think the best way to deal with this issue is to allow the animal to reside in the lot. It will only take a week or so for other owners to determine if it has become a nuisance. AND THEY WILL COMPLAIN …as nothing is worse than a troublesome dog or cat. Then the animal can become removed as that, a nuisance!

        We are all entitled to enjoy our lots without noise or nuisance wether it be from noise or fumes or being bailed up by a dog on exiting or entering our lots.

        If the animal is quiet, well behaved,etc and the owner is acting responsibly by removing waste and carrying the animal on Common Property then there would reasonably be no avenue for complaint.

        I believe you pretty much just own the air space of your property. Though most owners use floor, walls and ceilings to do their own thing. Without permission from OC and without usually complaint. Fittings are another issue. So under the floor would be common property. In fact the ceiling and the floor would be considered common property I think. But this would depend on why you are asking this question and what it relates to?

        Dear Pink/Purple, your council dictates how many visitor spaces you must have so you must comply with that. Your strata manager will be able to provide you with Strata Plan for your building.

        Does the Act specify animals must be carried or on a leash when on Common Property?

        May not help your current situation with clean up but surely if an animal is supervised this 'accident' would not occur.

        Dear Wet and Wild,

        Have you attended meetings? My feeling is you have not. Perhaps if you have the time and inclination to do so you may have some resolution.Then again you may be in a building where no action is taken but I feel you need to act first. Executive Commitees volunteer their time. So don't be so hard on them. ECMeetings Minutes only need to be posted on board but the larger issues you are bringing up need to go to an AGM. Those minutes should be in detail and posted to you. Perhaps you should put your hand up at the next AGM for a position on the EC? If you are an owner you have a voice so use it! If the Strata Managers are not responding to your complaints you can always ask CTTT for mediation.You should already be corresponding as as an owner with defects on your own accord, the EC are not responsible for your complaints. You should download Strata Living from the Office of Fair Trading or if you have the heart, THE STRATA SCHEMES MANAGEMENT ACT.Confused

        Hi Mara, trimming of large trees rely on council approval even if they are on your property so you will need to request the strata manager or EC to apply to council for permission to have trees trimmed. And there is a fee. In my experience this may take some weeks and is best if you request a site inspection. Often council do not approve of trimming unless you can prove that limbs etc are within so many metres of your property or causing severe nuisance. You can check your councils website for info.

        In regards to the rubbish, yes the OC should deal with this but if I was selling my unit I would probably just clean it up myself!

        You may just need to check with your Strata Manager if you are digital ready. Just went through the same, $1100 later we have a digital aerial, amp etc and after having no reception for 6 weeks we are now back on track.Smile
