I agree with Whale, best to start your own paper trail. Reply to all correspondence in writing and refer to the telephone calls as in ‘further to our telephone conversation on such n such a date’. This way your replies will probably be sent on to the relevant parties. Possibly the complaint will be sent to the EC and your replies should then be too.

Hi Ruffy, don’t like your chances as this is a recent decision made by the OC in response to previous bad experiences with dogs in the building. It would be such a long involved process for you to change the bylaw that I feel you would be much better off to just rent to the next applicant. Are you on the EC? You would need to request an EGM and get a majority I think to change the bylaw. JT will be able to give you the details but I personally would just rent to a non pet owner for now as it is not your own pet so best to pick your fights otherwise strata issues can take months and sometimes years to resolve. Mind you, if you are interested in changing the bylaw you should start doing so as it may help in the future.

Totally agree with JT and scotlandx, nobody knows what happens behind closed doors, noise travels in apartment blocks and can be confusing. Why on earth would you choose the worse case scenario and possibly cause some innocent person distress? Say hi to your neighbour and ask or send a request through the SM.
To digress slightly, I have watched this space for a number of years, posted and gained much insight, received help and all thanks to JT and his devoted fans and fellow strata dwellers, negative posts are good, they are what we mostly
all have in common, but I have to say recently there have been some seriously negative posters that make my experience less than pleasant. Is that the price of popularity?Cheers, CBF

Hi All, I believe in addressing both the asthetics as well as the practical and cost saving. What we have in our plan is an outdoor area with clothes lines that have screeenining walls. We also approve of drying of laundry on balconies and courtyards using a clothes horse so long as the height is not above the height of the balcony railing and NEVER is laundry to be hung over balcony railings. I think I have posted this previously. We need to consider first of all the appearance of our plan and property value, we do not wish to appear a shanty town but with increased electricity costs it would be just plain stupid to not dry laundry naturally.
I believe the Strata Regulations are now changing to reflect this.
cdinoz, have you checked the bylaws for your plan? Look carefully at the wording you may not actually be in breach!

Hi all, I meant to reply to a similar post previously but it slipped my mind.
I was under the impression there are no proxies at an EC Meeting. I had always believed a proxie could be used at any meeting, until we recently engaged a strata solicitor to advise and attend EC and GMeetings regarding a big issue. He informed the OC that you could not have proxies at EC Metings. Only general meetings. So what and who is right?

!!Thanks for the info JT. I am glad our building have so far not been put in that position, where an Owner has nominated a tenant for a place on the EC , so we have not as yet ‘broken the law’, it has just been an interpretation and understanding of the act, clearly myself and our EC did not read thoroughly, so you have certainly given me as usual some further understanding of how we need to run our building.

Can they? I was under the impression only an Owner could be a member of an EC.
In my building only Owners are permitted a position as well as only Owners attending meetings, unless of course we invite a tenant or have a request from a tenant to attend a meeting regarding an issue that concerns their Lot and the Owner has not been responsive.

Hi Whale,
In your position I would not even consider who is responsible if you are satisfied the Lot is not unclean and have attempted to eradicate, just ask the EC to address at next meeting suggesting the building be treated for pests at the OC expense. It is usually not an expensive exercise. We treat our building in the common areas every few years as a precaution rather than wait until there is an issue with rodents, cockroaches etc. Perhaps you could do the same and also make a special visit to the Lot with the mice? Before they take over the rest of the building? Cause they breed like..well..mice!

Alternatively, you could try posting a letter adressed to the EC c/o the address Body Corporate letter box, if the buiding has one. The Secretary of the EC or a member has access to this not the Strata Manager.

Hey Struggler, I sympathise, but gotta say there is some inaction by all. Don’t doubt your EC is incompetent. But really there is only one place for your files to be, with the previous SM. If the new agreement has not been signed files cannot be sent to anyone.Legally. When the agreement is approved by the OC, files will be sent to new agent. The OC needs to approve not the EC. EC are not decision makers for CP nor responsible re this. This should have been decided at AGM and the SM should have authority to sign off on OC behalf then. All financials should be at the current/previous SM until legalities are confirmed. So can be viewed.The onus should fall on your previous SM as they should still hold files and provide access to until the new agreement is signed. So badger them. Probably not what you want to hear, sorry.
